I am on H1B visa currently and wanted to know if I am eligible to file Green Card under EB-1C category.
I moved to US few months back on H1 B visa and have been associated with sister company of the same US company for more than 10 years abroad. I have been working at a Managerial position at two sister companies in two different countries for more than 3 years.
I did some reading on pre-requirement for EB1-C category and it says that I must have worked at least for an year at managerial position for one of the sister companies abroad of the same company for which you are working in US. This requirement is being satisfied though.
My employer applied for my H1B visa 4 years back and at that time by designation I was not Manager (although I have been actively engaged in looking after the operations of one of the company's branches abroad and reporting to VP or CEO). Employer applied for my H1B at that time and had my designation as Principal Engineer. My H1 was approved in about an year but my employer did not call me in US until few months back recently. During this period I got promoted to Manager and Senior Manager at sister company abroad in two different countries (all same company). Now when I moved to US, my employer changed my designation to Manager but I am still on the same H1B visa that was issued 4 years back. Currently I am acting as a Manager (managing team of 8 people, looking for prospective clients for the company and reporting directly to VP)
Questions:
1. Am I eligible to apply for Green Card under EB1-C category?
2. Do I need to reflect my promotion\Change in designation to Manager on H1B before applying for GC in EB1C category?
3. What is the best and recommended route to Green Card. Should I go H1B -> GC under EB1C or H1B -> L1A -> GC EB1C keeping in view that I have already lost 3 years of H1B visa
