Will same employer apply for cap based h1b with 1 year gap instead of applying for GC when h1b tenure expires?

My h1b is going to expire in just 8 more months and I will be back on H4. I started out of US for more than a year now.

Can the same employer hire me or apply cap based h1b if I do COS to H1b ?
