I got a FT opportunity but I will be traveling to India before Joining on Dec 9. I am leaving to India on Oct 28.Also, I dont want to break the bridges with my existing employer with whom I am working on consulting projects. Is it ok if I give notice to him while I am on vacation. Company wants to do my H1b transfer when I am out of country. How does it impact my return?
1. When company applies my LCA and H1b transfer when I am out of the country?
2. Company applies my LCA while I am in US and H1b transfer while I am out of the country?
3. Is it necessary to get approval/receipt for both LCA/H1b while I am in USA?
4. Will they issue I-94 (online) in my case because I will be out of country?
5. What will happen to my First H1b if the second one is denied?
6. What do I need to show on my return during Port of Entry from the new transfer/old h1b?
Please advise if this is safe or not. What is the risk % in both these cases. Overall my concern is, If all this process is done when I am out of country, will it affect me at the port of entry in my return to States.
