What is the status between h1b approval and L2 visa extension denial date

My L2 visa which is expired in April and I have applied for an extension.
ALso, I got another employer who filed h1b change of status for me. My h1b approved as COS with new i94 from October.

Will I be able to legally stay in US until then and can I start working?

I believe you will be out of status if it is denied.

Currently you can not change status in the US and must immediately depart, and attempt "stamping" for H-1B at the overseas consulate. Hope you have a good lawyer.
