Can I stay on H1b if my GC is rejected?

Question

I am using my h1b and on my 8th year which is valid till May 2016. I applied for a change of status that is, green card by filing I-485/AOS. What if it is rejected can I still stay in US with my valid h1b until May 2016?

Will i be eligible to refile the I-485/AOS based on previous Labor and I-140 or do I need to go through the process again to file labor and I-140

Off course you can stay in US with your valid h1b even if your green card petition is rejected.

You can reapply for GC provided you follow the time gap requirements and also the documentations needed.  Why it was rejected? Well your employer might know this
