My Employer applied H1B this year under premium processing nder advanced degree quota.

My OPT expired already. and received a temporary I-20..I went to the DSO at school after my H1B was approved to get an updated CAP GAP I-20 that would state my extension until september 30th, but my DSO says, I am legal to stay in US until sept 30th, but cannot work until then because I was H1B approved 20 days after my expired OPT and so I lost the work authorization status until sept 30

What do I do in this case now

Timing of the approval is not relevant. As long as the qualifying petition was timely filed, you get your OPT automatically extended until September 30, 2013.

It looks like your petition was timely filed, so your work authorization was automatically extended with your F-1 status.
