Applying h1b after being out of status

My brother came to US on B1/B2 visa and then he applied for a TPS.
His application was rejected due to lack of nationality evidence as he didnt carry the birth certificate. He exceeded his status limit for 2 months and now, if he finds a company who is willing to sponsor him, is it possible that he can apply for h1b visa?

Or will he need to go out of state and get his visa and re-enter?

Off course, the employer can file for him

Since he is out of status he needs to go back to his country, get the visa and re-enter
