After I exceed the L1b limit, how long am I eligible to stay if I have a valid h1b?

My L1b got expired on June 2006 but my i-94 is valid till 2016. The maxout limit date is Oct 9th 2013. My h1b has processing has some issues because there was a mistake in the petition filed by my employer. My i-797 is approved.
I am asked to leave US on Oct 9th. My new born kid has no passport and visa to enter India.
What options do I have now?

You must consult the attorney for this as this is very specific question. How much time have you spent on L or H1b visa in US? Whether you were on L1b or L1a ?

Is your company trying to give you a h1b transfer?
