Traveling when Extending h4 visa and holding h1B visa

My h1b is approved from Oct 2013, but my current status is h4.
Both mine and my wife's(h1b) are expiring soon in Aug 2013. Though we filed for extension, its still under review.

What happens if my wife travels to India during this time even before USCIS makes any decision on the extension?
Will there be RFE or rejection due to this?

Also, if the extension status makes RFE or rejected, then will that cause a problem for me to start working in Oct 1st?
Would the stay be considered as legal since I was waiting for extension process or will I be sent out of the country for visa stamping?

She has to take this to an attorney who knows the case in very detail. Let her talk to her employer's attorney, that will be much easier.
