COS from L2 to H1b

My L2 visa is expired and my i94 is valid until 2016. I work for a company on L2 EAD.
Husband is on L1 visa, and his H1b is in process through his employer, which just got approved. Now, his status changes from L1b to H1b from Oct 2013. So, at that time my L2 visa will not longer be valid.

Now, my company has filed h1b w/o COS and it is approved. If they apply under premium processing, will I be able to stay and work in US till my COS is approved?

You can still stay in US legally, but you cannot work until your COS gets approved.
