h1b transfer applied after 3 months from lay off date

hi, i was laid off on 15th july 2015 from my last employer, i got offer letter from new company on 23rd Oct 2015 and they filed h1b transfer on 4th Nov 2015. MY h1b visa is valid till may 2017 and i94 too is valid till may 2017. my previous employer revoked my petition on 23rd september 2015. How safe is my case for approval? I know i have been out of status since july 2015.  What are different scenarios that can happen in my case? I only know my extension of stay might get denied and I need to re enter US with same visa. What else can happen? Please help

I think your employer should file H1B consulate notification . Go India. Do Stamping. Come back.

I have stamping in my passport and valid I-94. We both did not have employer for specific time period so We must have to do this process.
