I was living in USA till September 2013. I have worked in USA for 3 years on an L1B visa. My L1 extension got denied hence have to leave US and got a transfer to Canada.
I had applied H1B through a small consultant, which I approval this week ( November first week 2013) . I am planning to schedule my interview in Canada.
The employer is saying to schedule the interview in Canada, payrolls are mandatory and he is gonna generate the payroll for a month and then he is asking me to attend the interview.
Can he generate a payroll, even though I am not physically located in USA. Is this legally good and an avaiable option to me. What will I say to the Visa officer, if he says that you are not physically present in the USA, during that period for which you are showing paystubs. Is there any risk with this option.
