Will working on 1099 for an employer while on H1B have any tax/legal issues?

Question

I had to travel India for some unavoidable reasons. I hold a valid H1B visa with my employer. He wants me to continue working from India. My current employer is providing me 1099 instead of W-2 for the period am working from India. Will this have any legal/tax issues? I will be back on W-2 once I return.
