Is it possible to submit h1b request 2 months before the intended start date through premium processing?

Is it legal to apply h1b extension submitted 2 months before the start date and will PP be processed then?
My PERM is under audit and currently I am in India.
Will I be able to extend h1b to coincide the 1 year since PERM was filed?
