My friend who had h1b status lost her job and now that she got another offer, the new employer is trying to file her h1b again.
The earliest they can file is right after 18 days of filing her lost job. Will the petition be approved with i-94 ?
Are there any chances that USCIS considers her as legally losing status and ban her from US?
