I stayed more than 180 under unlawful presence in US. My attorney filed for Nunc Pro Tunc extension of stay petition + H-1B petition. He got an approval email from USCIS.

Is there a way to know if USCIS has forgotten my unlawful presence?
Do they send any letter? Or should i assume if I get a new i-194 with approval notice that my extension of stay was approved.

The company filing for your H-1B extension  will request a filing receipt date back to the date of the previous I-94 expiration.

Thus an individual in this position would have any accrued unlawful presence forgiven if the petition is approved. The new I-94 and receipt notice will be proof.

Would you please let me know if your i-94 was retroactive (pre-dated) after a successful nunc pro tunc? what reasons/ evidence did you have to submit for the extension under NPT?
