Premium procssing for H1b

Question

I had h1b for more than 6 years and i am refiling it now based on I-140 approval and I-485 pending, but I am currrently out of status. Will i be eligible for CAP exempt?

I am trying to get it processed through Premium processing. Which office should I got and file petition vermont or California?

our employer files the H1 petition. CIS office to send to will depend on the work location. If you have a I-485 pending, you are not out of status.
