How bad is DUI record for h1b processing?

Question

My OPT STEM is expired in Jul 2013 and exceeded my grace period of 10 days, so got arrested for DUI.
I can't defend my DUI case that easily, though my plan was to apply for job early next year and get an h1b visa through the job.
If i hire a lawyer, then my DUI case will stay pending during my h1b processing. I know I am guilty in this.

Will I be safe to re-enter US with ESTA/VWP? (I am South korean citizen)

Hire a DUI attorney to resolve this issue as the conviction can affect you being hired later in the furture if they are strict about background checks, criminal checks etc.
