Unlawfully staying in US with H1b

My H1b was approved in Feb 2011 and valid through Jan 2014. I made a trip outside US in December 2011.
I got I-94 when I re-entered US which expires in November 2012, that was when my passport would expire.

Now that i renewed my passport before it expired, but did not realize that I needed new I-94, I am overstaying in US unknowingly for more than 180 days after I-94 expired.

1. Now I want to work with the employer on H1b, how can it be possible?
2. If I ask for a new i-94, can the CBP arrest me?
3. Is it possible to apply for H1b extension later?

Please tell me what would be the best option to avoid a ban of 3 years? I want to at least stay on H4 with my husband.

In whatever case, you are not authorized to work currently based on the situation you explained.
