H1b out of status and CAP exempt

I got I797 approved from my current company. So, I am under the H1b CAP and this is valid for 6 more years even though I didnt travel to US on H1b Visa gaining the status.
Will I be eligible for CAP exempt for H1b transfer to the new company?
