Can I file H1b when MTR is in progress?

My MTR is in progress through my employer which takes 3-6 months and my H1b is denied when I am in my cap gap period. I registered to a University in order to save my status.

Is there a possibility that another employer can file a fresh h1b during MTR wait process next April?

You wont be able to do that since your H1b status is expired. Also, when your MTR is in progress there is 80% chance you may get rejected.
