If I stay out of USA for 1 year will it be counted under the cap or will it be cap exempt?

I have stayed 5 years on L1 and got H1 visa on the sixth year. Since my visa expires in 2013, can I apply for a new H1B visa in 2014? Will this be counted under cap or cap exempt?
