H1B Extension

H1B started on Oct 2009 and expired on Oct 2012 and i was in India all these 3 years .Completed Masters in US.can i apply for H1 again or need to file in the fresh quota. Please Suggest me.

Since you didnt activate your h1b status, you can not file under cap exempt.
