Will I be able to continue working if AOS is pending and valid h1b visa and i94 expires?

Question

I am on H1b visa valid till 2015. I have family based i-130 and AOS in progress with USCIS.

i-94 expires in a month or so. I have my finger prints appointment next week and there will be another month or2 before my EAD arrives.

 

I can legally stay after september if i-94 expires because of pending AOS.

 

Will i be able to continue after the expired date till I get my EAD?

Will i be considered out of H1b in that time?

If you have valid EAD after your h1b expires, then you can stay here. Else you wont be able to stay.
