H1b transfer on un-used visa, can it be cap-exempt?

Though I had valid h1b, i could not get the right project on time and could not be deployed on client place. So, the slots are filled up by US locals in less than 3 months.
Hence my h1b status is un-used. It is already expired now without using it.
Is it possible to transfer with a new employer without pay stubs? Will that be cap-exempt?
OR
Will that be considered as new application?

There is still a lot of information needed. Unfortunately, if you havent activiated your h1b, that will no longer be valid.
Check with immigration lawyer for options.
