PERM denia before H1b extension and filing a new PERM

My h1b based on pending PERM is used for 7 years. I have got an update that my PERM was denied. Request for reconsideration was filed but DOL certifying officer has filed a denial and forwarded an appeal to BALCA for review process. My attorney is processing a new PERM in parallel so my employer will withdraw the appeal when the new PERM case is ready to file by November 2013.
 

Now my old h1b expires on Aug 2014. However, my concern is that if the new pERM is audited and denied, then my employer cant extend my h1b. Wife is also on h4 visa.

Will I be able to continue my work in USA with these exceptions?

Your employer should have done long back, you are almost towards the end now..
