I am right now on STEM extension OPT after my undergrad. This is going to expire in February. My employer says they cant sponsor H1b for me. I am running out of time so I somehow got hold of a doctor's office who can help me sponsor h1b.

Is it possible to apply in the next fiscal year since we know OPT is expiring?
If not, when should I continue going to school, spring or summer 2014?

Besides this, is it ok to apply h1b through a new employer and recommend a attorney for legal help?

You will have aronund 60 days grace period to file h1b petition after OPT expires. You can stay in US until the H1b start date in Oct 2014, however you may not be eligible to work for any employer until then.

H1b petitions can be filed so if it is within 60 days of expiration, then do it.
You can get addditional OPT only if you go back to school for another degree.
