H1B transfer without a last paystub

Hello,

I was working with a company in bay area for about a year now, they had sponsored my H1B visa this year which started effectively from Oct 1st. Now, because of personal problems I had gone on the unpaid medical leave with this company. Basically, I wanted to look for new jobs in this time and I have already found one.

I have not resigned yet neither they have terminated me, I'm still employed by them but not getting paid since Oct1st. I have a new offer from another company and they are willing to transfer my H1B soon, it may still take couple of more weeks to process.

My question is that:

1. When I send my H1B application to USCIS in next week Nov 3rd, i won't have my last two paystubs i.e. 15th Oct and 30th Oct. Would that be issue in there? My company has not revoked my first H1B petition yet as I am on unpaid leave which means I am still on the status. I also have the official leave approval signed by my manager. Please let me know your insights on my situation.

Ask your payroll, technically a paystub should be generated with payout as $0

 

You can ask payroll that you need to prove employement eligibiltiy with latest paystub for loan / lease etc and I am sure they can help you !
