I got my H1B visa on 2006 and traveled to US in 2007 and worked till Feb 2008 (exactly One year) and then came back to India and never went back to US. Can i be eligible to file for new cap-exempt H1B now since i have a) Worked in the US in last 6 yrs on valid H1B then b) Still have 5 yrs left out.
Is my more than 1 yr stay in India an issue? Will that expire my "cap-exempt" criteria?
