My visa expires Sept 30. I could capture the time I have been out that could extend me to end of October/2013.

My labor certification was file May 2013. My company inquired about it and were told that currently the labor filled as of January 24 are being processed. At this point I am thinking that I would have to leave the country as I will be out of Status. If I do that, and my labor gets approved while I am out, would my company be able to apply for the I140 and then submit an h1b extension?
