Hi, I am working in USA on H1B visa and my wife is here with me on H4. Our I-94 expires on Sep 29, 2014. She wants to start working here and put her resume on some of the Employment Sites. One of the consultant asked for her I - 94 status and said if her I-94 is valid anytime before Oct, i.e. even if it ends on 29th Sep then they cannot apply H1 visa for her.
Is this true?
I will anyways have my extension filed and will have my H1 extended. Can she not apply for a H1 visa?
