Leaving US without joining new company after h1b transfer is complete

Question

Company1 holds my h1b who recently accepted my offer with another company. They processed my h1b transfer in premium.

I got approval notice and reciept number.

 

I do have a plan of going out of US on vacation. Also, I am trying to resign company1 and join company2 when i return.

 

1.will it be an issue in POE if I enter with visa stamp with Company-A + I-797 from company-B but, without any payslips or bank statements proving my employment with company-B? 

 

2.  Is it okay if I process H4 for my spouse with new company2?

You can always leave US even if you do not have a valid visa. The rest of the questions should be answered by the attorney for company2
