Will i be able to enter US just 10 days before my h1b is expired?

my first H1B visa stamped in Canada in August 2013. Before my H1B was approved, I was working in the US on a different visa. After I obtained my H1B and my old visa got canceled,the company who sponsored my H1B told me that they might not be able to hire me.

 Can I enter the US 10 days before Oct.1 regardless of whether or not the company will hire me? In other words, can I wait in the US while the company makes its decision? Or is it better to wait in my home country? 

 

Are there any legal implications for the company if they don't hire me, as I quit my older job based on their offer? Or are they free to do this?

Yes, you can try But you might go on record as having lied to the immigration officer at the airport. It is better to wait for the decision at home.
