Hi,

My wife is on H1-B working for a consulting firm. She is a fulltime employee working out of the company's office. She reports directly to the COO of the company. Although her company places consultants on various client sites (body-shopping) but she is not a consultant with them and in-fact is a full time employee. She wants to go to India and get her H1-B stamping done. Her previous H1-B stamping is from Australia and before that she got her H-4 stamping from India when she initially came to US. Its been 5 years she has not gone out of US.

The company has filed her Green Card in EB2 and she has her I-140 approved too.

Please advise how risky is it for her to go to India and get the stamping done.
